ORDINANCE  NO. 3
             
AN ORDINANCE REGULATING EXHIBITION DRIVING AND THE USE OF VEHICLES ON THE STREETS AND ALLEYS OF THE CITY OF ROYALTON AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.

 

                       THE CITY COUNCIL OF ROYALTON HEREBY ORDAINS:
                                                                                                                                    

SECTION  1.               MAXIMUM SPEED

(a)     It shall be unlawful to drive a vehicle on any street within the City of Royalton at a speed in excess of 30 miles an hour, unless otherwise posted.         
(b)     It shall be unlawful to drive a vehicle on any alley within the City of Royalton at a speed in excess of 10 miles an hour.   
           
SECTION 2.                EXHIBITION DRIVING

(a)     No person shall operate a motor vehicle on a public highway, street, parking lot, alley or other public property, or private property without the consent of the owner, in such a manner as to cause any of the following:
A.    Spinning or skidding of the wheels or tires.
B.    Squealing or similar noise from the driving tires.
C.    Defacing the roadway with black marks or indenting the roadway by skidding or spinning of tires.
D.    "Fishtailing" or skidding sideways.
E.    Rapid intermittent application of the accelerator making the vehicle bounce up or down or make excessive noise.
F.    Accelerating in an excessive manner in an apparent contest commonly referred to as "Drag racing". 

(b)     Drive or operate a vehicle on a public highway, street, parking lot, alley, or other public property, or private property without consent of the owner, at erratic or irregular and changing speeds so as to create a hazard to themselves or other persons or property, or to interfere with other traffic in the area.
                                                                                         
SECTION   3.              ANGLE PARKING      

(a)     Angle parking is allowed only on; that portion of Birch street running one half block south of Center street, the west side only. On that portion of North 1st. street between Highway #10 and the alley, the south side only. On North Aspen street, between North 3rd. street and North 4th. street, the west side only, and on that portion of North 2nd. street on the North side between Cedar street and Driftwood street, on the South side between the alley and Cedar street. All other streets shall have parallel parking only.
(b)     As used herein "Angle parking" shall mean parking a vehicle at an angle of approximately 45 degrees or more with the curb.

 

SECTION 4.                PARKING RESTRICTIONS - WINTER

(a)     When snow has accumulated to a depth that requires plowing and/or removal; all vehicles including trailers parked and/or standing on city streets and alleys in the City of Royalton shall be towed to an impound lot at owners expense.
(b)     It shall be the duty of the Royalton Police Department to maintain a log of vehicles towed so that any subsequent infractions each snow season may also result in a citation being issued besides towing the vehicle at owners expense.
(c)     This order shall not include parking lots, back yard parking, or private driveways.

SECTION 5.                YEAR-ROUND PARKING RESTRICTIONS.

(a)     No vehicle or trailer shall be parked on City of Royalton streets or alleys for over forty-eight (48) consecutive hours.
(b)     No vehicle shall park on the wrong side of the street (face against traffic). Only vehicles exempt from this section are all emergency vehicles, City work vehicles or delivery vehicles and those listed in section 3.
(c)     No vehicle or trailer shall be parked on the grass between the street and the residence.   
(d)     Vehicles in violation of this order may be towed at owners expense.           
        
SECTION 6.                CITY PROPERTY PARKING RESTRICTIONS.

(a)     No vehicle or trailer shall be left unattended and without permission on Royalton City property for over forty-eight (48) consecutive hours.
(b)     Vehicles in violation of this order may be towed at owners expense.

SECTION  7.               PENALTIES.              

(a)     Violation of this ordinance is a Petty Misdemeanor.              

        
                              THIS ORDINANCE SHALL SUPERSEDE AND REPEAL ALL PRIOR AND CONSISTENT ORDINANCES. THIS ORDINANCE SHALL BE EFFECTIVE UPON PASSAGE AND PUBLICATION REQUIRED BY LAW.
