ORDINANCE NO.  30

            AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE.
THIS ORDINANCE: PROVIDES FOR THE APPLICATION, ADMINISTRATION, AND ENFORCEMENT OF THE MINNESOTA STATE BUILDING CODE BY REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF ROYALTON; PROVIDES FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREOF; PROVIDES PENALTIES FOR VIOLATION THEREOF. THIS ORDINANCE SHALL PERPETUALLY INCLUDE THE MOST CURRENT EDITION OF THE MINNESOTA STATE BUILDING CODE WITH THE EXCEPTION OF THE OPTIONAL APPENDIX CHAPTERS.
           
                        THE CITY OF ROYALTON DOES ORDAIN AS FOLLOWS:
           
           
SECTION  1.       BUILDING CODE.                                                                                                                                            
                                                                                   
(a)     The Minnesota State Building Code, established pursuant to Minnesota Statutes 16B.59 to 16B.75, including all of the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Administration, through the Building Codes and Standards Division is hereby adopted by reference for the City of Royalton, one copy of which is on file in the office of the City Clerk of Royalton. The code is hereby incorporated in this ordinance as if fully set out herein.

(b)        The Minnesota State building Code includes the following chapters of Minnesota Rules:
1.         1300 Administration of the Minnesota State Building Code
2.         1301 Building Official Certification
3.         1302 State Building Construction Approvals
4.         1305 Adoption of the most current International Building Code
5.         1307     Elevators and Related Devices
6.         1309     Adoption of the most current International Residential Code

SECTION  2.      APPLICATION, ADMINISTRATION AND ENFORCEMENT.       

(a)     The application, administration and enforcement of the code shall be in accordance with Minnesota Rule Chapter 1300. The code shall be enforced within the incorporated limits of the City of Royalton permitted by Minnesota statute 16B.62 subdivision 1 when so established by this ordinance.

(b)     The code enforcement agency for the City of Royalton is called the Building Official.

(c)     A Minnesota certified Building Official must be appointed by the City Council to administer the code. This Official shall be appointed by the City Council by resolution and kept on file in the office of the City Clerk of Royalton.
                                            
SECTION 3.         PERMITS AND FEES.

(a)     The issuance of permits and the collection of fees shall be as authorized in Minnesota statute 16B.62 subdivision 1.

(b)    In addition, a surcharge fee shall be collected on all permits issued for work governed by this code in accordance with Minnesota statute 16B.70.

 

SECTION   4.         VIOLATIONS AND PENALTIES.           

(a)       A violation of the code is a misdemeanor (Minnesota statute 16B.69) and Minnesota Rules, Chapter 1300.

                              THIS ORDINANCE SHALL SUPERSEDE AND REPEAL ALL PRIOR AND CONSISTENT ORDINANCES. THIS ORDINANCE SHALL BE EFFECTIVE UPON PASSAGE AND PUBLICATION REQUIRED BY LAW.
