ORDINANCE NO. 4.04
AN OPDINANCE RELATING TO THE LICENSING AND SALE OF CIGARETTES, CIGARETTE PAPERS, CIGARS AND OTHER TOBACCO, AND PROVIDING PENALTIES FOR VILATION THEREOF.
TUE VILLAGE COUNCIL OF ROYALION ORDAINS:
 
SECTION 1. It shall be unlawful for any person to sell at retail within the village limits cigarettes, cigarette paper or wrappers, unless duly licensed as hereinafter provided.

SECTION 2. Applications for a license to sell at retail cigarettes, cigarette paper or wrappers, shall be in writing, signed by the applicant, and shall show:
(a) the name and address of the applicant; (b) the place of business where such sales will be made, the name of the owner thereof, and the kind of business conducted therein; and  (c) whether the applicant within one year preceding the date of filing of said application was convicted of a violation of any statute or ordinance relating to the sale of tobacco to a minor, nor shall it issue a license until the fee there for has been paid to the village treasurer,

SECTION 4. The license fee shall be $12 a year, except that no fee shall be charged to those persons who by statute are exempt from paying such fee.

SECTION 5. Licenses issued pursuant to this ordinance are transferable with the consent of the village council. Every license shall expire on the 31st day of December following the date of issuance. If any license is issued when less than one year remains to the expiration date thereof, a pro rata fee shall be charged. Every license shall be posted at all times in a conspicuous manner in the licensed premises.

SECTION 6. No Licensee or his employee shall sell, give, or in any way furnish tobacco to any person below the age of eighteen years, knowing or having reason to know that such person is a minor below the age of eighteen years. Violation of this section shall be a penal offense punishable by a fine of not more than $30 or by imprisonment in the village or county jail for not to exceed 30 days.

SECTION 7. The village council may revoke any license issued pursuant to this ordinance for thefollowing causes: (a) a material misrepresentation of fact in the written application for license; and (b) conviction of the licensee of a violation of any statute or ordinance with respect to the sale of tobacco to a minor.

SECTION 8. As used herein, the word “tobacco’ shall mean cigarettes, cigars, or any form of tobacco; the word “person” shall mean any person or persons, partnership, association or corporation.

SECTION 9. Except as otherwise provided in Section 6, violation of any provision of this Ordinance shall be a penal offense and any person convicted thereof shall be punished by a fine of not more than $100 or by imprisonment in the village
or county jail for not to exceed 90 days.
