ORDINANCE NO. 8                                                        
          
AN ORDINANCE REGULATING THE PRESENCE OF MINORS 17 YEARS OF AGE AND UNDER IN PUBLIC PLACES AND ON THE STREETS OF ROYALTON, MINNESOTA BETWEEN CERTAIN HOURS. DEFINING DUTIES OF MINORS, PARENTS OR OTHERS IN CARE OF MINORS. PROVIDING FOR ARREST AND PENALTIES FOR VIOLATION THEREOF.

 

THE CITY OF ROYALTON HEREBY ORDAINS:

         
SECTION  1.        It shall be unlawful for any minor 17 years of age and under to loiter, idle, wander, stroll or play in or upon any public streets, highways. roads, alleys, playgrounds, public places, public buildings, places of amusement or entertainment, vacant lots or other unsupervised places within the City of Royalton, between the hours of 10:00 P.M. and 5:00 A.M. the following day except that on Friday and Saturday said hours shall be 11:00 P.M. and 5:00 A.M. of the following day.                                                                                                                                                                    
SECTION  2.        It shall be unlawful for the parent, guardian or other adult person having the care and custody of a minor 17 years of age and under to knowingly permit said minor to loiter, idle, wander, stroll or play in or upon any public streets, highways. roads, alleys, playgrounds, public places, public buildings, places of amusement or entertainment, vacant lots or other unsupervised places within the City of Royalton, between the hours of 10:00 P.M. and 5:00 A.M. the following day except that on Friday and Saturday said hours shall be 11:00 P.M. and 5:00 A.M. of the following day.           
        
SECTION 3.         The provisions of Section 1 and 2 of this Ordinance shall not apply to a minor accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or when the minor is upon an emergency or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor.

SECTION   4.       A "School Night"

(a)       A "School Night" is any night during the school year so designates by the Superintendent or Principal of the public schools conducted in the City of Royalton on which school functions or activities are held, such as an athletic, musical or social  event or any other school program to be so designated. Notice of such School Nights must be given in writing by the Superintendent or Principal to the City Clerk or Police Chief preferably three days in advance, but at least twenty four hours in advance of the event or program. The notice shall include a statement as to what classes, groups or grades of students are entitled to attend the event or program.                             

(b)       The provisions of Section 1 and 2 of this Ordinance shall not apply to male and female students 17 years of age and under who are lawfully attending, going to or returning from any school function on a properly designated "School Night".
                       
SECTION  5.        Each violation of the provisions of these sections shall constitute a separate offense                                         

SECTION 6.         Any person who violates any of the provisions of this Ordinance is guilty of a Misdemeanor.

 

         THIS ORDINANCE SHALL SUPERSEDE AND REPEAL ALL PRIOR AND CONSISTENT ORDINANCES. THIS ORDINANCE SHALL BE EFFECTIVE UPON PASSAGE AND PUBLICATION REQUIRED BY LAW.
