REGULAR CITY COUNCIL MEETING
May 19, 2009
7:00 P.M.

Mayor Lauer called the Regular City Council meeting to order. The pledge of allegiance was said. On roll call members present were: Lauer, Libke, Klosowski, Verley, and Gutzkow.
People present: Tim Majaski, Planning and Zoning; Terry Lehrke, Morrison County Record; Adam Gunderson, Chief of Police; Nathan Bellefeuille, RFD; Carol Madsen, City Clerk.
Gutzkow made a motion to approve the minutes of the Regular City Council meeting on May 5, 2009, 2nd by Verley. Put to a vote with all members voting aye. Motion carried.
Verley added one discussion item and Libke added one discussion item to the agenda. Mayor Lauer removed item 5 & 6 regarding 212 E Centre Street from the agenda.
No Public forum.
Mayor Lauer reported that Minnesota Power has a rebate program that will cover approximately $1300.00 of the cost to change the signal lights to LED lighting. The Company that the current bulbs were purchased from will not buy back the old bulbs. Libke reported on an article that he read about Portland using the LED lights. More accidents were caused because the LED lights did not generate enough heat to melt the snow and ice off them. Mayor Lauer will contact the City of Duluth since they have changed to LED lights to see if they have had any problems. MN DOT should also have some information on this issue.
Klosowski reported that South Side Sand & Gravel did the last grading of Acorn Road in 2008. Donald Dubbin, South Side Sand & Gravel, said he would build the crown back up on the road. Klosowski will talk to them and get a quote on maintaining it on a regular basis.
Police Chief, Adam Gunderson, presented a resolution to the Council for the Safe and Sober Communities Project. Verley made a motion to adopt Resolution 5-19-09-1, A Resolution authorizing the execution of the Agreement for the Project “Safe and Sober Communities”, 2nd by Gutzkow. Put to a vote with all members voting aye. Motion carried.
Tim Majaski, Planning & Zoning Chairman, reported at the LMC Safety and Loss Control Workshop he learned that the 180 day re-build clause, if a building burns down, the owner has 180 days to re-build in the same spot if they have the exact same footprint even if they don’t meet the current setbacks, is permissible, but he can’t find it in the state statutes. He will research further.
Tim Majaski, Planning & Zoning Chairman, reported that in the Nuisance Ordinance, the weed inspector can go on private property to inspect for noxious weeds, but the City cannot go on private property to inspect for other nuisances. However, the League of MN Cities states that you cannot go on private property with out a search warrant. He will research further.
Tim Majaski, Planning & Zoning Chairman, reported that he is still looking for the owner of the annexed property from Langola Township (Duevel property). He will continue to research. The owner is apparently in Florida, but will be returning shortly.
Libke reported on May 12, 2009 he and Councilmember Gutzkow, met with Police Chief, Adam Gunderson and some 1st Response members. Some 1st responders were concerned about Adam responding to calls with out checking in at the fire hall first. Since Chief Gunderson is not a member of the team he does not have to report to the fire hall before responding. The radio channel to respond was also discussed, so Chief Gunderson can let them know if he is responding to the call. It was decided to look at the job descriptions and how Chief Gunderson is to respond to calls outside of the city limits and set up some protocols.
Klosowski reported he will be meeting with Morrison County Soil & Water Conservation Dept. on the Skate board park site Friday, May 22, 2009 at 9:00 a.m.
Libke made a motion to pay all bills, voucher no’s 28957 – 28977, in the amount of $254,578.95, 2nd by Klosowski. Put to a vote with all members voting aye. Motion carried.
Klosowski made a motion to adjourn at 7:40 p.m., 2nd by Verley. Put to a vote with all members voting aye. Motion carried.
