REGULAR CITY COUNCIL MEETING
  SEPTEMBER 22, 2009
  7:00 P.M.

Mayor Lauer called the Regular City Council meeting to order.  The pledge of allegiance was said.  On roll call members present were: Lauer, Libke, Verley and Gutzkow.  Absent:  Klosowski.
 
People present: Tim Majaski, Planning and Zoning; Lynn Jensen, Morrison County Record; Adam Gunderson, Chief of Police; and Carol Madsen, City Clerk.

  Libke made a motion to approve the minutes of the Regular City Council meeting on September 8, 2009, after the clarification that Paul Kapsner did not request the $2500.00 annual budgeted city contribution, 2nd by Verley. Put to a vote with all members voting aye.  Motion carried.

  Agenda approved as presented.

  No Public forum.

  Libke gave a Fire & Rescue Department report. 

  Libke made a motion to approve KDV to do the 2009 annual audit at a cost of $13,250.00, 2nd by Gutzkow.  Put to a vote with all members voting aye.  Motion carried.

  The RFP (Request for Proposal) for Refuse/Recycling Collection for the City was discussed.  It was placed on the October 6, 2009 Regular City Council meeting.

  Verley gave an update on the Skate Park Project.  Verley made a motion to authorize Council Member Verley to accept the low bid on the cement work for the Skate Park Project, and make any other small purchases needed to keep the project moving along, 2nd by Gutzkow.  Put to a vote with all members voting aye.  Motion carried. 

  Tim Majaski, Planning & Zoning, reported he had spoke with Tom Wenner, City Attorney, on the legalities of banning all new septic systems and private wells within the city limits.  Mr. Wenner said the City can’t do this because it would make the property less valuable.   Planning & Zoning will continue to research the ISTS Ordinance. 

  Majaski presented the changes to the Zoning Ordinance, Section 17.09, to include the 180 day rebuild clause; also in Section 3.01, the statement about annexed land being placed in the Agricultural Zoning, will be removed.  According to Tom Wenner, City Attorney, all annexed land is filed as Residential with the State of Minnesota.  The changes will be made and brought back to the October 6, 2009 Regular City Council meeting.

  Libke made a motion to pay all bills, voucher no’s 29194 – 29224, in the amount of $43,084.12, 2nd by Gutzkow.  Put to a vote with all members voting aye.  Motion carried.

  Gutzkow made a motion to adjourn at 7:50 p.m., 2nd by Verley.  Put to a vote with all members voting aye.  Motion carried.
